Acceptance of terms
By accessing or using torchsec.com (the "Site"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Site.
These Terms are between you and Torchsec Technologies, LLC ("Torchsec," "we," "us," "our"). If you're using the Site on behalf of a company, you represent that you have authority to bind that company.
The Site & informational services
The Site describes our managed cybersecurity, IT, and compliance services. Content here is for informational purposes. Nothing on this Site constitutes legal, compliance, or security advice to your specific situation, and nothing on the Site creates a service relationship until there is a mutually signed agreement.
Forms on the Site — contact, free assessment, newsletter — are offered as-is. We'll do our best to respond promptly, but we make no guarantee about response time or that we'll be able to serve your specific need.
Managed services are governed by a separate agreement
These Terms do not grant any service entitlement. No SLA, deliverable, or credit described in our marketing is binding unless it appears in your signed MSA or SOW.
Acceptable use
When using the Site, you agree not to:
- Attempt to gain unauthorized access to any system, account, or data.
- Probe, scan, or test the vulnerability of the Site or its infrastructure without our prior written permission.
- Interfere with or disrupt the Site's availability, including via automated traffic, credential stuffing, or denial-of-service techniques.
- Submit false, misleading, or deceptive information through our forms, or impersonate any person.
- Scrape, harvest, or redistribute content from the Site without our written permission.
- Use the Site to transmit malware, unsolicited commercial messages, or unlawful content.
- Reverse-engineer or attempt to derive the source of any part of the Site beyond what is permitted by law.
Security researchers: coordinated, good-faith reports are welcome at security@torchsec.com.
Intellectual property
The Site, including text, graphics, the Torchsec flame mark, logos, and the overall design, is owned by Torchsec or its licensors and is protected by U.S. and international copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for lawful informational purposes only.
"Torchsec," "Torchsec Technologies," and the Torchsec flame are trademarks of Torchsec Technologies, LLC. All other trademarks referenced on the Site — HIPAA, PCI DSS, SOC 2, NIST, CMMC, Radware, and others — are the property of their respective owners, used for descriptive and informational purposes.
Feedback you voluntarily send us ("Hey, you should do X…") is non-confidential, and we may use it without obligation or compensation.
Third-party content & links
The Site includes links to and embeds from third-party sites — for example, the Radware Live Threat Map, news feeds, and our assessment partner portal. We don't control those sites and we're not responsible for their content, availability, or practices. Your use of linked sites is governed by their own terms and privacy policies.
Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the Site will be accurate, complete, or current, or that security-related content reflects the most recent threat landscape at any moment in time.
Cybersecurity is adversarial and probabilistic. Nothing on the Site guarantees any particular security outcome. Guarantees, if any, apply only as specifically stated in a signed MSA/SOW.
Limitation of liability
To the maximum extent permitted by law, Torchsec and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising from or related to your use of the Site, even if we've been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or related to the Site or these Terms is limited to one hundred U.S. dollars (USD $100). For contracted services, liability limits are governed by your MSA, not this Site's Terms.
Some jurisdictions do not allow certain limitations — if that applies to you, the limitations above apply to the fullest extent permitted.
Indemnification
You agree to indemnify and hold Torchsec harmless from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your breach of these Terms, (b) your violation of applicable law, or (c) your misuse of the Site.
Governing law & disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Virginia, and you consent to personal jurisdiction and venue in those courts.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you don't agree to the updated Terms, your remedy is to stop using the Site.
